PDPL Informative Text

As, ÖZEL YAŞAM DİYALİZ MERKEZİ, we process your personal data within the scope of the Law on Protection of Personal Data No. 6698 (“PDPL”) and the relevant legal legislation and in the scope described below with the capacity of “Data Controller”.

1. Collection, Processing and Processing Purposes of Personal Data

Although your personal data may vary depending on the relationship between you and the ÖZEL YAŞAM DİYALİZ MERKEZİ, it may be collected verbally, in writing or electronically, by automatic or non-automatic methods, by the units affiliated to the ÖZEL YAŞAM DİYALİZ MERKEZİ , the website and similar means. The main general and special personal data, especially the personal health data required for the execution of all medical diagnosis, examination, treatment and care services and obtained for this purpose, are listed below;

Your Identity Information, your name, surname,  Your T.R identity number, if you are not a Turkish citizen, your passport number or temporary Turkish identity number, place and date of birth, marital status, gender,

Your insurance or patient protocol number and a copy of the TR Identity Card or Driver's License you submitted,

Your contact data such as your address, telephone number, e-mail address,

Your financial data such as your bank account number, IBAN number, credit card information, billing information;

Your data on private health insurance and Social Security Institution data for the purpose of financing and planning health services;

Your health and sexual life data obtained during the execution of medical diagnosis, treatment and care services such as your laboratory and imaging results, test results, examination data, prescription information, which you submit for the purpose of tracking in your file,

Your closed circuit camera system video and audio recording taken during your visit to our dialysis centers,

Your browsing information, IP address, browser information, and medical documents, surveys, form information and location data that you transmit with your consent, obtained during the use of our website.

If you apply for a job at the ÖZEL YAŞAM DİYALİZ MERKEZİ, your other personal data, including the CV, provided in this regard, and, if you are an employee of ÖZEL YAŞAM DİYALİZ MERKEZİ or an associated employee, your service contract and any personal data related to your work aptitude.

Your personal data listed above and your sensitive personal data may be processed by ÖZEL YAŞAM DİYALİZ MERKEZİ for the following purposes;

Protection of public health, preventive medicine, medical diagnosis, treatment and care services, determination of identity

Planning and management of health services and financing, planning and management of internal functioning and daily operations of our dialysis centers, supply of medicines, informing you about the appointment if you make an appointment,
Fulfilling legal and regulatory requirements,

Preserving the data that must be kept in accordance with the relevant legislation, sharing the requested information with the Ministry of Health and other public institutions and organizations,

Making evaluations and researches in order to improve health services,

Confirmation of your relationship with hospitals and medical centers and institutions contracted,

Invoicing for our health services, sharing the requested information with private insurance companies within the scope of financing health services,

Carrying out risk management and quality improvement activities,

Answering all your questions and complaints about our health services,

Taking all necessary technical and administrative measures within the scope of data security of the systems and applications of our Dialysis Centers,

Measuring, increasing and researching patient satisfaction,

Analyzing your use of health services and storing your health data,

Training and development of our employees,

Monitoring, preventing and reversing abuse and unauthorized transactions,

It will also be possible to process your personal data in the following cases even if you do not give your express consent:

Provided that it is clearly stipulated in the law, that it is compulsory for the protection of the life or physical integrity of the person who is unable to express his/her consent due to actual impossibility or whose consent is not legally valid, that it is necessary to process the personal data of the parties to the contract, that it is directly related to the establishment or performance of a contract, that it is compulsory for the ÖZEL YAŞAM DİYALİZ MERKEZİ to fulfil its legal obligation, that it has been made public by the person concerned, that data processing is mandatory for the establishment, use or protection of a right, provided that it does not harm the fundamental rights and freedoms of the person concerned, they may be processed by ÖZEL YAŞAM DİYALİZ MERKEZİ, without seeking explicit consent, in cases data processing is obligatory for the legitimate interests of the ÖZEL YAŞAM DİYALİZ MERKEZİ, and your personal data regarding health and sexual life may be processed, but only for the purpose of protecting public health, conducting preventive medicine, medical diagnosis, treatment and care services, planning and managing health services and financing,

2. Explicit Consent for Personal and/or Special Personal Data:

Applicants to the ÖZEL YAŞAM DİYALİZ MERKEZİ will be deemed to have given permission for the receipt, processing and domestic transfer of personal / or private category personal data within the scope of the legal regulation by signing the "Explicit Consent within the Scope of the Personal Data Protection Law" together with their name and surname information, at the time of application.

It should be taken into consideration that the service cannot be provided partially or completely, as the service can be provided through the sharing of personal data and cannot be obtained from the persons or companies and organizations from which the service is received, in other words, that the services specified in "personal data processing purposes" cannot be provided partially or completely if necessary permissions are not given in terms of personal data. Because, without prejudice to exceptional circumstances, it should not be ignored that the provision, processing and transfer of personal data is necessary in order to provide the services specified in the "personal data processing purposes". ÖZEL YAŞAM DİYALİZ MERKEZİ does not accept any responsibility and ÖZEL YAŞAM DİYALİZ MERKEZİ has no responsibility for the failure to provide the services specified in the "personal data processing purposes" due to the lack of necessary approval for the provision, processing and/or transfer of personal data.

3. To Whom Your Processed Personal Data Can Be Transferred And For What Purpose

Your personal data may be transferred to, within the framework of the Health Services Basic Law No. 3359, the Decree Law No. 663 on the Organization and Duties of the Ministry of Health and its Affiliates, the Law on the Protection of Personal Data No. 6698, the Regulation on Private Hospitals, the Regulation on the Processing and Privacy of Personal Health Data and the regulations of the Ministry of Health and other legislation. and for the purposes described above;

ÖZEL YAŞAM DİYALİZ MERKEZİ and its units,

Ministry of Health, sub-units of the Ministry, family medicine centers

Social Security Institution, General Directorate of Security and other law enforcement agencies,

Judicial authorities

General Directorate of Population, courts and enforcement offices,

Turkish Pharmacists Association, regulatory and supervisory bodies,

Insurance companies, third parties authorized by patients,

Electronic Medical Records and Electronic Health Records systems, company servers and data storage units,

Third parties we consult, including lawyers, tax consultants and auditors we work with,

Our suppliers, support service providers, archive service providers and business partners whose services we benefit from or cooperate with,

SAP applications and backup systems

within the framework of the personal data processing conditions and purposes specified in Articles 8 and 9 of the KVK Law.

4. Method and Legal Reason for Personal Data Collection

Your personal data is collected and processed in all kinds of verbal, written, visual or electronic media, to carry out all kinds of work within the legal framework, including the above-mentioned purposes and the field of activity of the Özel Yaşam Diyaliz Merkezi, and in this context, in order for the Özel Yaşam Diyaliz Merkezi to fully and duly fulfil its contractual and legal obligations. The legal reason for the collection of your personal data;

Law No. 6698 on the Protection of Personal Data,

Decree Law No. 663 on the Organization and Duties of the Ministry of Health and its Affiliates,

Health Services Basic Law No. 3359,

Regulation on the Processing of Personal Health Data and Protection of Privacy,

Ministry of Health regulations and other legislation provisions.

Private Hospitals Regulation,

In addition, as stated in paragraph 3 of Article 6 of the Law, personal data on health and sexual life may  only be processed without the explicit consent of the person concerned, by persons under the obligation of secrecy or by authorized institutions and organizations for the purposes of protecting public health, preventive medicine, medical diagnosis, treatment and care services, planning and management of health services and their financing.

5. Data Processing Time:

Your personal data is processed for a limited period of time that requires the fulfilment of the purposes described in this Informative Text and in any case, in accordance with the practices of ÖZEL YAŞAM DİYALİZ MERKEZİ and the practices of its commercial life, as a requirement of the purpose-limitation principle and after the expiry of the terms, they are deleted, destroyed or anonymized. Besides these, your data, which is mandatory for ÖZEL YAŞAM DİYALİZ MERKEZİ to fulfil its legal obligations as data controller, in cases expressly stipulated in the laws, made public by the data subject himself, and which must be processed for the legitimate interests of our company, which has the title of data controller, provided that it does not harm the fundamental rights and freedoms of the data subject, may only be used for the realization of the purposes listed as a limitation in this sentence in the event that the periods specified under this title expire.  For these reasons, your stored personal data will not be allowed to be accessed for any other purpose and can only be used in essential situations. Your personal data will be duly deleted, destroyed or anonymized in the event of the expiration of the necessary conditions.

Your Rights Regarding the Protection of Personal Data

In accordance with the law and relevant legislation; you have the following rights by applying to the ÖZEL YAŞAM DİYALİZ MERKEZİ;

  • to learn whether his/her personal data are processed or not,
  • to demand for information as to if your personal data have been process,
  • to access and request your personal health data,
  • to learn the purpose of processing and whether it is used for this purpose,,
  • to know the third parties to whom it is transferred in the country or abroad,,
  • to request correction if it is incomplete or incorrectly processed,
  • to request the deletion or destruction of your personal data within the framework of the conditions stipulated in Article 7 of the Law,
  • to request notification of the transactions made pursuant to subparagraphs (e) and (f) to third parties to whom personal data has been transferred,
  • to object to the emergence of a result against the person himself by analyzing the processed data exclusively through automated system,
  • to demand the compensation of the damage in case of loss due to unlawful processing of personal data.

You may deliver your requests under the law by filling out the “Personal Data Protection Law Application Form” at the “www.yasamdiyaliz.com.tr” web address;

by proxy through notary public; original copy of the form, showing that you are authorized to make an application for the rights listed in Article 11 to the ÖZEL YAŞAM DİYALİZ MERKEZİ Clinical Finance and Administrative Affairs Officer personally or with a document identifying your identity, and with a notarized power of attorney.

Your requests submitted to the ÖZEL YAŞAM DİYALİZ MERKEZİ will be answered in writing or electronically, as soon as possible and within thirty days at the latest, in return for the processing fee determined in Article 7 of the Communiqué on the Procedures and Principles of Application to the Data Controller, depending on the nature of your request.
